General Terms

Sure Thing Ltd (trading as Tradie Insurance) has teamed up with ANDO Insurance Group Ltd (ANDO)to bring you an insurance offering called Tradie Insurance.

By purchasing your insurance policy online and ticking the ‘I accept the terms and conditions’ box you accept these terms and conditions.

We may change or update the content of the website, including these terms and conditions applicable to the website, at any time without prior notice. These terms and conditions are in addition to, and do not replace, any specific terms and conditions applicable to any underwritten product, service, or promotion.

 

Who is who

  • you’ and ‘your’ are a reference to you and any legal entity or company you have notified as an insured party or entity; You agree that you have the authority to act of behalf of the insured entity, company, or organisation you have specified in your application.
  • User’ means you, a person who has purchased a policy through this website.
  • All references to ‘we’, ‘us’, ‘our’ are references to Tradie Insurance. Tradie Insurance is a Registered Financial Service Provider: FSP Number 573587 .
  • Services’ means any one or more of the services offered by Tradie Insurance
  • Application’ means the total of the questions you answer in order to have a policy issued to you. This is also known as the ‘Insurance Proposal
  • Website’ means this website through which the services are offered;
  • Insurer’ means the underwriter of your insurance policy.

Specific Terms

Tradie Insurance is an online insurance marketplace. From time to time we may add new insurance products and services to the marketplace. We will inform our users/policyholders of new products. The policy wordings, and summaries for each product are available on the site, and will provided to you when you purchase a policy.

 

Getting Insured

Becoming a User: You become a client/user/member of Tradie Insurance when you purchase your first policy. You agree that you are in a position to form a legally binding contract that is enforceable against you or the insured organisation you represent.

Accurate Information: You warrant that you have provided complete, accurate and current information when applying for cover with us. You must maintain and update your personal information held by us to ensure it is kept current at all times. We may phone, email or mail you to verify these details.

Termination as User: Tradie Insurance reserves the right to decline to register, or to terminate your user without entering into further discussions with you. Without limiting the foregoing.

Security of your information: We will provide you with policy information and may provide you with login details. You are responsible for keeping your information, including your email address and any password, secret and secure. We do not hold or store credit card details.

Emails and newsletters: Tradie Insurance will send you emails relating to your insurance, and your transactions. Tradie Insurance may also send you emails for promoting and marketing other products and services to you. You can unsubscribe anytime from the mailing list by clicking the “unsubscribe” link at the bottom of the email.

Important Obligations

Your obligations: as the insured party:

  1. You must comply with all warranties, endorsements and conditions of the insurance contract (policy wording).
  2. You are to act in good faith at all times.
  3. You must comply with all statutory requirements and common law rules relating to the transacting of insurance business.
  4. You have a general duty of disclosure to Tradie Insurance. You are responsible on an ongoing basis for providing us with all material facts relating to the insurance contracts you transact online. Material facts are those that would influence an insurer when they were deciding whether to accept the risk, and the terms and conditions that would apply. Failure to provide full and accurate information may mean that your cover is reduced, cancelled, or if the non-disclosure is fraudulent, the insurer may be able to avoid the contract from the beginning. If you are in any doubt as to what facts are considered to be material you should disclose them to us.
  5. You must provide accurate, complete and timely information to us. You are responsible for all information you provide in any online application/proposal, claim form or other material document. We are not responsible for checking the accuracy or completeness of any information you provide to us or any insurer. We will not be responsible for any consequence resulting from a failure by you to disclose all material facts to an insurer (including, without limitation, the possibility of your insurance policies being rendered void or limited)
  6. You must advise us as soon as is reasonably practicable of an event or circumstance that may give rise to a claim or potential claim. If you do not inform us (or your insurers) of such a claim or potential claim you may prejudice your rights under your insurance contracts. You will be advised if you need to complete or produce documentation to support your claim.
  7. After receiving your insurance documents from us, you should check them and advise us promptly of anything that does not meet your requirements. Any errors should be notified to us immediately.
  8. Please note that we have no obligation to fund any premium, taxes or fees (if applicable) on your behalf and we have no responsibility for any loss you may suffer as a result of insurers cancelling the insurance or taking any prejudicial steps as a result of non payment.

Disclaimer: You expressly understand and agree that:

  1. It is Tradie Insurance’s and/or the insurers decision whether to offer and continue to provide you with insurance cover.
  2. Information provided on the website is of a general nature only and should not be taken as advice that is specific to your particular situation or business.
  3. No advice or information that is obtained by you from Tradie Insurance or anyone else shall create any warranty by Tradie Insurance that is not expressly stated in these terms and conditions or the terms and conditions of your policy contract; and
  4. You are required by law and by contact to act in good faith and disclose all material circumstances, and you are solely responsible for this as the insured.
  5. Tradie Insurance is not responsible for protecting members from credit card fraud.
  6. Tradie Insurance facilitates the payment with Stripe Payments, it is not responsible for the misuse of credit card information. Stripe is a SSL secure payments system.

Indemnity: You agree to release, indemnify and keep indemnified us from and against all actions, claims, costs (including legal costs and expenses), losses, proceedings, damages, liabilities, or demands suffered or incurred by us to any person arising out of or in connection with your failure to comply with these terms and conditions.

Representation: We make no representation or warranty concerning the solvency or ability of any insurer to pay claims. In New Zealand, insurers are required to comply with the provisions of the Insurance (Prudential Supervision) Act 2010. Any policy documentation will show the particular insurer’s claims paying rating. We only deal with insurers who have an A- rating or stronger.

Breach: Without limiting any other rights and remedies available to Tradie Insurance, we may limit your activities on the Website, or refuse to provide our Services to you if you breach these terms and conditions and/or where we consider it appropriate your insurance policy(s) may be cancelled with appropriate notice;

Policy Cancellation: We or your insurer may cancel your insurance policy. 30 days notice of the intention to cancel must be provided. If we or the insurer determine that, either from the information you have provided or due to any perceived breach or due to a change in underwriting parameters, they do not wish to continue to insure you. If this happens you will be issued with a 30 day cancellation notice by email. A pro-rata refund of the premium will be provided to you once the cancellation is made

Renewal of Your Insurance Policy: Policy renewal may be offered to you prior to the expiry of your annual policy. We will email you approximately 30 days prior to the renewal of your policy advising you of the upcoming renewal of your policy. If renewal is offered, your policy will automatically be renewed through TradieInsurance and your renewal documentation will be issued via email. Payment is also automatic and will be on your expiring card payment details. Should you no longer wish to renew your Insurances, let us know following your pre-renewal notification and we will ensure that you are not charged and your policy will be lapsed.

How we make money

  1. We receive commissions from the insurers for introducing your business to them. The commissions are paid both when you first take out the policy and every time you renew it.
  2. Additionally, we charge a $20.00/year Member Admin Fee, and reserve the right to change the administration fee charged at any time. We will notify you by email if there are any changes to this fee.

Additional fees and charges

  1. All ‘Policy Charges’ are inclusive of relevant government levies; including Fire Service Levy and Government Earthquake Levy – if applicable. These levies will be detailed on your invoice.
  2. All quotes on the website are exclusive of any Goods and Services Tax (GST). Applicable GST charges are added to your Online Shopping Cart.

If you cancel the policy early

We don’t repay the annual Member Admin Fee, or the commissions from service providers for arranging your insurance policy. The insurer may be required to repay a pro-rata amount of the Policy Charge.

 

Other General Things

Force Majeure: We have no liability for any lack of performance, unavailability or failure of the Services or the Website, or for any failure to comply with these terms and conditions where the same arises from any cause reasonably beyond our control.

No Waiver: If we do not exercise or enforce any right available to us under these terms and conditions, it does not constitute a waiver of those rights.

Partial Invalidity: If any provision of these terms and conditions becomes or is held to be invalid, unenforceable or illegal for any reason, and in any respect, that provision shall be severed from the remaining terms and conditions, which shall continue in full force and effect.

Governing Law: These terms and conditions are governed by the laws of New Zealand. You submit to the non-exclusive jurisdiction of the Courts of New Zealand.

Intellectual Property Rights: Tradie Insurance (and its licensors or suppliers, as the case may be) owns all proprietary and intellectual property rights in the Website (including text, graphics, logos, icons and sound recordings) and the software and other material underlying and forming part of the Services and the Website.

You may not without our prior written permission, in any form or by any means:
Adapt, reproduce, copy, store, distribute, print, display, perform, publish any part of this Website; or Commercialise, copy, or on-sell any information, or items obtained from any part of this Website.

Entire agreement: These terms and conditions supersede all previous conditions, understandings, commitments, agreements and representations whatsoever whether oral or written, and constitutes the entire agreement, between the parties, relating to the subject matter of these terms and conditions.

Privacy: We collect personal and risk related information about you through your use of the Services and the Website; including your details and information relating to your use of the Website and the content you access.

NMIB may disclose your personal information to third parties for the purposes of evaluating, providing, processing and maintaining your insurance policy or as required by law. Third parties may include The Hollard Insurance Company, Ando Insurance Group Limited and any of its partners, insurers and suppliers.

This is necessary for an insurer to underwrite the risk. You agree that this information will be provided to insurers and another person involved with underwriting the risk or assessing/managing any claims.

You agree that Tradie Insurance may use this personal information to assist us to provide the Services to you, for internal research purposes, to verify your identity, for promoting and marketing other Tradie Insurance products and Services to you, and for any other use that you authorise.

Currency: All premiums, charges, excesses, fees, insured values and other figures referred to or requested are in New Zealand Dollars.
